Statement of Privacy

We are a corporation named Qualicare of America, Inc. (“Qualicare”). Qualicare is committed to protecting and respecting the privacy of any and all Personal Data that it gathers in the course of doing business, as defined by the Data Protection Act 2018 (DPA), the California Consumer Protection Act (CCPA), and any other potentially applicable statutes. We collect only the essential information needed to perform the functions required by Qualicare. Qualicare has taken steps to ensure the information is stored in safe, secure locations with access only granted to those employees who require the information in order to perform their employment responsibilities.

This Statement of Privacy (“Statement”) explains when and why we collect Personal Data about you. We may change this Statement from time to time, but we will not treat your Personal Data in a fashion inconsistent with the Policy at the time your information is collected without notifying you.

Qualicare collects information for the purpose of providing healthcare services to the interested party, or regarding potential interest in an open job offered by Qualicare or its franchisees. Qualicare will not disclose any information about individual users. Any information provided by a client or prospective client to Qualicare is strictly confidential. Qualicare will not sell any information obtained or provided by a client to a third party for marketing or other purposes but we may use that information for marketing purposes which may involve providing your information to a third party.

This Statement of Privacy applies to the Qualicare website and governs data collection and usage. By using the Qualicare website, you consent to the data practices described in this Statement.

Collection of Your Personal Data

We obtain information about you when you use our website, when you provide it to us or to our franchisees or, occasionally, from third parties.

Qualicare is not responsible for the privacy statements or other content on websites outside of the Qualicare and Qualicare’s family of websites.

Please be advised to not include any health or sensitive information when you use these functions.

If you make a payment to us your payment details are not held by us but are collected by our third party payment processors, who specialize in the secure online capture and processing of such transactions.

      • We use this information to communicate with you, deliver the services you have requested, and inform you of other products or services available from Qualicare and its affiliates.

    • We use this information to operate our service, to maintain quality of the services, and to provide general statistics regarding use of the Qualicare website.

Sharing of Your Personal Data

Qualicare does not sell, rent or lease its customer lists to third parties. Qualicare may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (e-mail, name, address, telephone number) is not transferred to the third party. In addition, Qualicare may share data with trusted partners to help us perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your Personal Data except to provide these services to Qualicare, and they are required to maintain the confidentiality of your information.

Qualicare does not use or disclose sensitive Personal Data, such as race, religion, or political affiliations, without your explicit consent.

Qualicare will disclose your Personal Data, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Qualicare or the site; (b) protect and defend the rights or property of Qualicare; and, (c) act under exigent circumstances to protect the personal safety of users of Qualicare, or the public.

Use of Cookies

The Qualicare website uses “cookies” to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. When you return to the same Qualicare website, the information you previously provided can be retrieved, so you can easily use the Qualicare features that you customized.

Security of Your Personal Data

Qualicare secures your Personal Data from unauthorized access, use or disclosure. Qualicare secures the personally identifiable data you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. When Personal Data (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol.

Unfortunately, the transmission of information via the internet is not completely secure. Although Qualicare will do its best to protect your Personal Data, Qualicare cannot guarantee the security of your data transmitted to its site; any transmission is at your own risk. Once Qualicare has received your information, it will use strict procedures and security features to try to prevent unauthorized access.

Please be aware that while our site’s email functionality is available for communication purposes, it does not guarantee complete security and privacy. Similar to other unencrypted internet email communications, there is a possibility that your email may be accessed and viewed by unauthorized individuals during transmission. Therefore, we advise against using our site’s email functionality to convey confidential information that you consider sensitive or confidential.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third 

Your Rights

You have the right to ask Qualicare not to process your Personal Data for marketing purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data. The Qualicare site may, from time to time, contain links to and from the websites of its partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that Qualicare does not accept any responsibility or liability for these policies. Please check these policies before you submit any Personal Data to these websites.

Notice for California Residents

This Section applies to our collection and use of Personal Data if you are a resident of California, as required by the California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”). Please note that for the purposes of this section, “Personal Data” has the same definition as Personal Information set forth in the CCPA. 

In the last 12 months we do not believe that we have Sold any Personal Data and we do not believe we currently sell Personal Data. “Sold” has the same definition set forth in the CCPA.

We do not believe we use or disclose sensitive Personal Data for purposes other than specified in the CCPA regulations, Section 7027, subsection (m).

We have collected Personal Data from our clients within the last 12 months. We can provide the categories of Personal Data collected, the sources the Personal Data is collected from and the use of the Personal Data within the last 12 months, upon request.

California Resident Privacy Rights

If you are a resident of the state of California, the following rights are available to you under the CCPA.

You have the right to be notified of what categories of Personal Data will be collected at or before the point of collection. You have the right to request that we disclose the categories of Personal Data collected, the categories of sources from which Personal Data is collected, the business or commercial purpose for collection, the categories of third parties with which we share Personal Data, and the specific pieces of Personal Data that we have about you. You also have the right to request that we provide your Personal Data to you in a readily useable format.

You have the right to request the categories of Personal Data that we collected in the previous twelve (12) months, the categories of sources from which the Personal Data was collected, the specific pieces of Personal Data we have collected about you, and the business purposes for which such Personal Data information is collected and shared. You may also have the right to request the categories of Personal Data which were disclosed for business purposes, and the categories of third parties in the twelve (12) months preceding your request for your Personal Data.

You have the right to receive the Personal Data you have previously provided to us.

You have the right to request that we delete Personal Data that we collected from you. Note, however, that certain requests to delete Personal Data may be denied if we are required to retain the data as a matter of law, the data is necessary for detecting security incidents, exercising free speech, protecting or defending against legal claims, or for internal uses reasonably aligned with consumer expectations.

You have the right to request that we correct any incorrect Personal Data we collect or retain about you, subject to conditions. Once you have submitted your request to legal@qualicare.org, we will correct your Personal Data in our records. Upon reviewing your request, we reserve the right to deny the request if (a) we are of the belief that the Personal Data we collect or retain about you is accurate; (b) correcting the data will be impossible; or (c) if the request conflicts with legal obligations.

You have the right to opt-out of the sale and sharing of your Personal Data.  When you opt-out of sales, we will not share your Personal Data with our advertising vendors or marketing partners. However, for Personal Data already shared, you will need to submit your access, deletion, and opt-out requests to each partner individually. You have the right to limit the use of your sensitive Personal Data for any purpose other than what is specified in CCPA regulations section 7027(m), which includes, without limitation, (i) performing the services reasonably expected by an average client who requests such services; and (ii) performing services on behalf of the business, provided that the use of the client’s Personal Data is reasonably necessary and proportionate for this purpose.

You have the right not to receive discriminatory treatment by us for exercise of these privacy rights. We do not offer financial incentives related to the provision of data.

You have the right to designate an authorized agent to make these requests on your behalf.

California Shine the Light

According to Section 1798.83 of the California Civil Code, individual users who reside in California and have an existing business relationship with Qualicare may request information about our disclosure of certain categories of personal information to third parties for direct marketing purposes, if any. 

Storage of Your Personal Data

The data that Qualicare collects will be transferred to, and stored at, a destination outside the European Economic Area (“EEA”). It will also be processed by staff operating outside the EEA who work for Qualicare or one of its suppliers. This includes staff engaged in, among other things, the fulfillment of your order, the processing of your payment details and the provision of support services. By submitting your Personal Data, you agree to this transfer, storing or processing. Qualicare will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Statement.

16 OR UNDER?

We are especially concerned to protect the privacy of children aged, 16 or under. If you are aged 16 or under, please ask your parent/guardian’s permission before providing any Personal Data and ask them to help you whenever you provide us with any Personal Data.

Changes to This Statement

Qualicare will occasionally update this Statement of Privacy to reflect company and customer feedback. Qualicare encourages you to periodically review this Statement to be informed of how Qualicare is protecting your information.
